Whilst collision scene evidence overwhelmingly indicated that BB was travelling in excess of the speed limit the Police Forensic Collision Investigator was unable to quantify BB’s approach speed due to the complexity of the tyre marks left by the car on the approach.</p> <p style="margin: 0cm; margin-bottom: .0001pt; line-height: 21.0pt;">FCIR provided forensic support to the investigation team and was able to calculate the approach speed of the car to be 30<em>mph</em> in excess of the speed limit. Consequently, BB pleaded guilty to Causing Death by Dangerous Driving.</p> Fri, 19 Jan 2018 00:00:00 +0000 Lorry Driver's Sight Line Accident Analysis https://www.fcir.co.uk/case-studies/sight-line-accident-analysis https://www.fcir.co.uk/case-studies/sight-line-accident-analysis <h2>Analysis of a Lorry Driver's Sight Lines</h2> <p class="lead">R v SP</p> <p>SP was the driver of an articulated lorry who was manoeuvring within a haulage yard when he collided with a pedestrian and fellow employee of the company concerned, (CB), causing him serious leg injuries.</p> <p>FCIR visited the yard and observed the company's working practices along with their published Health and Safety Guidance. The Police investigation at the collision scene identified a complex series of tyre marks caused by the motorcycle as AB tried to avoid the car. The Police Forensic Collision Investigator who assessed the marks concluded that AB had commenced braking from a speed in excess of the 30<em>mph</em> speed limit. Consequently, no further action was taken against GC.  After FCIR's analysis in the Civll forum, it was clear that the original analysis was flawed and FCIR were able to revisit all of the evidence. </p> <p> </p> Sun, 21 Jan 2018 00:00:00 +0000 Pedal Cycle Accident https://www.fcir.co.uk/case-studies/pedal-cycle-collision https://www.fcir.co.uk/case-studies/pedal-cycle-collision <h2>Pedal cycle and car collision</h2> <p class="lead">R v SD</p> <p>SD was facing a custodial sentence for Causing Serious Injury by Dangerous Driving, whereby the Crown had identified a pattern of mobile phone usage by SD during the journey in which the collision occurred. A plea to Careless Driving had been rejected by the Crown. However, following the thorough analysis of the mobile phone data FCIR were able to provide compelling evidence that supported SD’s account that had remained consistent from their initial account at the collision scene, which then ultimately lead to their acquittal at Crown Court.</p> Sun, 21 Jan 2018 00:00:00 +0000 Black Box Analysis https://www.fcir.co.uk/case-studies/black-box-analysis https://www.fcir.co.uk/case-studies/black-box-analysis <h2>Analysing Black Box (Incident Data Recorder) Data</h2> <p class="lead">R v ZT (Appeal)</p> <p>ZT was the driver of a car that had collided with and killed a pedestrian. Following trial ZT was convicted of Causing Death by Dangerous Driving and imprisoned. The Crown's case relied on the Police Forensic Collision Investigator’s analysis of a series of tyre marks found at the collision scene where ZT had swerved pre and post impact and yawed in their efforts to avoid the pedestrian, before colliding with a tree. Black Box evidence recovered from a system in the vehicle installed by ZT’s insurance was not considered by Police.</p> <p>The safety of the conviction was in debate based upon the Police’s analysis of the tyre marks and the absence of any analysis of the Black Box data.</p> Sun, 28 Jan 2018 00:00:00 +0000
